The AL!VE mobile application ("AL!VE" or the "App") is operated by Sherill Industries ("Company," "we," "us," or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms of Service. If you do not agree, do not use the App.
You must be at least 13 years of age to use the App. Certain features including 18+ events are restricted to users 18 and older. By using the App you represent that all registration information you provide is accurate and complete.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at support@joinalive.app of any unauthorized use.
You retain ownership of content you submit (including event flyers, photos, videos, descriptions, and tags). By submitting content, you grant the Company a non-exclusive, worldwide, royalty-free, sublicensable, transferable license to use, reproduce, modify, adapt, publish, display, and distribute your content in connection with operating, promoting, and improving the App and AL!VE-related services. This license includes the right to render your content in link-preview cards on third-party platforms (e.g., iMessage, social media, search results) when users share your event, and the right to use anonymized or aggregated forms of your content for analytics, recommendations, and platform improvements.
Event flyers may be processed by automated content-moderation tools (including third-party AI services) to enforce these Terms and our community guidelines. All content is subject to review and we may remove or restrict any content at any time at our sole discretion.
AL!VE is strictly an event discovery and marketing platform. AL!VE does not organize, host, sponsor, promote, manage, or operate any events listed on the platform. The presence of an event on AL!VE does not constitute an endorsement or guarantee of any kind.
The Company expressly disclaims all liability for the accuracy of event listings, the quality or safety of any event, any injury, death, property damage, or financial loss arising from attendance at any event, any cancellation or change to any event, the conduct of hosts or attendees, or any ticket sales or payment disputes.
As a host, you agree to indemnify and hold harmless the Company from any claims, damages, losses, and expenses arising from your events, your content, or your violation of these Terms.
Hosts are solely responsible for obtaining all permits, licenses, and insurance required for their events, complying with all applicable laws, ensuring venue safety and capacity compliance, and managing ticket sales and attendee disputes.
Some events on AL!VE are listed from publicly available sources (event flyers shared on social media, public event announcements, public business profiles) so that attendees can discover them. Auto-listed events are clearly marked in the App with a "📋 Listed" badge and a notice on the event page explaining the listing.
Auto-listed events display factual information about a publicly announced gathering (date, time, venue, host name or handle). Where a flyer image is included, the original host's social handles are tagged for attribution where available. Listing on AL!VE does not constitute endorsement of, sponsorship by, or affiliation with the listed host.
If you are the host of an auto-listed event:
AL!VE respects the rights of content owners. If you believe an image, flyer, or other material on the App or our website infringes your copyright, please send a written notice to dmca@joinalive.app including:
Upon receipt of a complete and valid notice, we will remove the material within forty-eight (48) hours and, where applicable, notify the user who posted it. AL!VE will terminate accounts of users determined to be repeat infringers in accordance with the Digital Millennium Copyright Act (17 U.S.C. § 512).
You agree not to use the App to violate any law, infringe intellectual property rights, harass or harm other users, post false or misleading content, or attempt to gain unauthorized access to any portion of the App.
The App offers two types of paid features. Host subscription plans (Pro Basic, Pro Mid, and Pro Premium) are billed monthly or annually through Stripe on our website at joinalive.app/host. Subscriptions may be cancelled at any time from there and take effect at the end of the billing period. We do not provide refunds for unused subscription periods.
One-time in-app purchases — including event boosts, featured placements, scan packs, and upload packs — are sold through Apple's In-App Purchase system. Apple is the merchant of record for these purchases. Refund requests for in-app purchases are governed by Apple's policies and may be submitted at reportaproblem.apple.com.
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. THE COMPANY MAKES NO REPRESENTATIONS REGARDING THE ACCURACY, SAFETY, OR LEGALITY OF ANY EVENT LISTED ON THE PLATFORM. ATTENDANCE AT ANY EVENT IS ENTIRELY AT YOUR OWN RISK.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES INCLUDING PERSONAL INJURY OR DEATH ARISING FROM ATTENDANCE AT ANY EVENT. THE COMPANY'S TOTAL LIABILITY SHALL NOT EXCEED $100 OR THE AMOUNT PAID IN THE THREE MONTHS PRECEDING THE CLAIM.
Any disputes shall be resolved by binding arbitration. You waive the right to a trial by jury and the right to participate in any class action. These Terms are governed by the laws of the United States.
